The website 'www.GoHeadHuntYourself.com' aims to bring employers, headhunters and jobseekers together through its service . The following terms and conditions apply to your use of this Website. You must read all the terms and explicitly accept these Terms of Use before you can make use of our service.

By using this service, users agree to be bound by the terms and conditions, which at any time by us can be adjusted. If you do not agree to these terms of use, you are not entitled to make use of our services.
 
ARTICLE 1 DEFINITIONS
1. "Organization" means the organization "Go Head Hunt Yourself"
2. "Agreement" means the agreement between the user and Go Head Hunt Yourself (including revisions) on the use of the website and the offered service;
3. "Fee" means the fixed amount of money that you as an Employer are due to Go Head Hunt Yourself if you hire a jobseeker through our Service
4. "Bonus" means the amount of money that you, as an employer, have awarded as a reward for the jobseeker that you have been approached through Go Head Hunt Yoursel and is hired by you..
5. "Registration Procedure" means the registration process the user should go through (including payment of subscription) before you can get access to the website and before you can post a vacancy;
6. “The service” The service offered by Go Head Hunt Yourself towards the user to be able to independently headhunt and being headhunted by others. Employer can actively or passively approach jobseekers or vice versa be approached by jobseekers whenever one of the parties chooses so, separately from each other. Go Head Hunt Yourself facilitates this service through its website
7. "Headhunting" this means that an Employer can actively or passively specifically search for jobseekers and jobseekers can actively or passively specifically search for companies who have current or future vacancies.
8. "Employer" is a through Go Head Hunt Yourself.com registered user who presents himself as an employer; and can provide a jobseeker with gainful employment in the capacity as an employer or acts as an intermediary, in person or on behalf of an organization or as organization, between an employer and the jobseeker
9. “Intermediair” a person who acts on behalf of a registered organization (employer) at Go Head Hunt Yourself, or an organization (employer) acting as an intermediair and registered as organization at Go Head Hunt Yourself, acting between an employer and the jobseeker. In both cases this entity that has the same obligations as an employer, specifically in regard to article 4 of this agreement. Bonus and fee is payable by the intermediary to GoHeadHuntYourself.
10. "Website" means the website 'Go Head Hunt Yourself located on the Web at www.GoHeadHuntYourself.com
11. "Jobseeker": a through Go Head Hunt Yourself.com registered user, who presents himself as being a jobseeker (candidate) from a working or from a jobless situation, or as a non-working student (not including student jobs), or a non-working trainee or an self-employed interim specialists
12. "User (s)" User (s) are employers / intermediaries, or jobseekers. As described in  Art 1.8 and 1.11) of the terms of use

 
ARTICLE 2 REGISTRATION PROCEDURE
1. To make use of the Service through the website, you are obliged to register at www.goheadhuntyourself.com. This requires that you will have to follow the on-line registration procedure at www.GoHeadHuntYourself.com
2. At first you should fill in the basic information which is requested. Then you can choose your subscription form and the way you want to pay through the website. At the time the payment is made (funds are received by the organization Go Head Hunt Yourself); you will receive at the e-mail address provided by you, your login name and password.
3. At second, once you loged in as an user, you are required to complete the registration process by providing correct, accurate and actual information, relevant to the matters referred to during the registration procedure (for employers e.g. contact names, phone numbers, e-mail addresses etc.). It is the responsibility of the user to keep the organization Go Head Hunt Yourself immediately informed in case of any changes, by changing the data on your personal page to the actual situation.
4. User is entirely responsible for the safety and proper use of all user records for all activities conducted through account (s) of the user.
The user is required and agrees to inform the organization GoHeadHuntYourself immediately in case of awareness of any unauthorized use of registration of the user or any other breach of security.
5. The user should immediately contact Go Head Hunt Yourself when user forgets or looses a password or username and is required to cooperate with a number of measures Go Head Hunt Yourself standard applies to you to obtain a new password and username.
6. Go Head Hunt Yourself can not be held liable for any loss or damage arising from the fact that the user has failed to comply with the provisions of Article 2 in this respect.
7. The employer indemnifies the organization Go Head Hunt Yourself if and where Go Head Hunt Yourself is held liable by third parties as a result of the employer not fulfilling its obligations under these Terms and Conditions, especially Article 2.
8. If the user provide information that is not true, not current or complete or if Go Head Hunt Yourself has a reasonable suspicion that the information is not true, not current or complete, then Go Head Hunt Yourself has the right (but is not required from his own point of view) to review the registration of User and to suspend or end users registration for the current or future use of the Service. In this case User can never claim back any subscription fees already paid.

ARTICLE 3 PLACE OF VACANCY
1 Once the user is registered and the registration procedure as a whole is completed, the User is accepted by Go Head Hunt Yourself and can make use directly of the Service of Go Head Hunt Yourself.
2 However, if Go Head Hunt Yourself at their discretion, notes at a later stage an illegal registration, Go Head Hunt Yourself is entitled to end users registration immediately so user can make no longer use of the Service (see also Article 2.8).
3 User is not allowed to include any contact information in the job description or in the CV, by which means, other than the intended by Go Head Hunt Yourself process, contact can be made between the employer and the jobseeker and by which the process of Go Head Hunt Yourself would be attempted to circumvent. The agreement between User and Go Head Hunt Yourself will in this case be terminated with immediate effect.
4 The content of vacancies and resumes which are posted on the website can be verified by Go Head Hunt Yourself on compliance with the agreement.
5 In case of any questions regarding the content of vacancies in relation to this agreement by  Go Head Hunt Yourself, Go Head Hunt Yourself will get in contact with the employer to consult possible vacancy adjustments. The employer agrees with the above method.
6 For any vacancy that employer's will post on the website Go Head Hunt Yourself, Employer will reward a Bonus involving a minimum amount of money, see also Article 4
7 Jobseekers who get into contact through the service of Go Head Hunt Yourself with the employer, as a result of a vacancy position, posted by employer, is entitled to the rewarded Bonus; if hired by this employer. This in compliance with Article 4.5 of the Agreement.
8 Go Head Hunt Yourself is entitled, but not required, to assess the data added by User in compliance with its business philosophy and professional appearance.
9 Go Head Hunt Yourself can under no circumstances be held responsible for any technical problems and / or deficiencies in any form whatsoever.
10 Go Head Hunt Yourself reserves the right at any time to refuse a vacancy or a resume, without giving any reason.

ARTICLE 4 BONUS, FEE, SUBSCRIPTION
1. By posting a vacancy, the employer is obliged to reward a Bonus. This is due and should be made payable to Go Head Hunt Yourself, plus the fixed fee and plus the applicable VAT to Go Head Hunt Yourself once there is the actual performance of the job (see also art. 5) The amount of the Bonus is determined by the employer, but must consist of a minimum of 650.00 US dollar, 425 English pound or 500.00 Euro. The employer may start with a higher Bonus or at any time increase this during the procedure. The bonus may not be reduced during an actual vacancy procedure.

2. The fixed fee for Go Head Hunt Yourself per successful completion of a vacancy is 650.00 US dollar, 425 English pound or 500.00 Euro. This fee is due and should be made payable to Go Head Hunt Yourself; included are the bonus and the applicable VAT of the total amount at the starting date of the actual performance of the job (see also art. 5).
3. The fee for Go Head Hunt Yourself can be increased once per year. Once increased, it will stay like this for a minimum period of 12 months or such longer period until the fee is adjusted again.

The new fee is applicable upon being posted on the website for new active jobs to be posted. Active jobs mean that an employer is seeking for jobseekers to fulfill an actual open vacancy.

4. The subscription fee can be increased once a year and is applicable for new subscriptions to be made. An adjusted subscription applies also for a minimum period of 12 months or such longer period until the subscription will be adjusted.
5. The bonus will be paid by Go Head Hunt Yourself to the jobseeker, who is hired by the employer, as part of its service, exclusively entirely spread over two periods, as the jobseeker also passed positively the legal test period, or with employer agreed upon trial period (not longer than two months). By the start date of employment, 50% of the bonus is payable to jobseeker. The remaining part, the remaining 50% of the bonus is payable only after successful completion of the trial period. The jobseeker / candidate agrees upon not to claim any interest payments of payments made by Go Head Hunt Yourself to the jobseeker. 

The employer must informe Go Head Hunt Yourself with the information that the candidate / jobseeker has passed positively the trail period by using
-the registration form “candidate hired” on the website, and 
-a responsible manager, working at the employer, will have to print out the form on company paper (with logo), fill in all the requested information and send it to Go Head Hunt Yourself

As Go Head Hunt Yourself appreciates the few remaining trees on planet Earth and therefore is a paperless organization, we accept only a scan of this form to our e- mail; This e-mail address is being protected from spambots. You need JavaScript enabled to view it   

 If the trial period is NOT completed successfully, at its sole discretion of the employer, and the employment contract with the jobseeker is ended due to not completing the trail period positively, Go Head Hunt Yourself will refund the remaining 50% of the original bonus to the employer. Employer recognizes in such cases not to claim any interest payments. The employer must inform Go Head Hunt Yourself with this information by using
-the registration form “claim bonus refund” and
-a responsible manager, working at the employer, will have to print out the form on company paper (with logo), fill in all the requested information and send it to Go Head Hunt Yourself

 The jobseeker accepts in such a case and agrees upon that in no way he or she is entitled to the second part of the bonus and will not claim this part at the employer or at Go Head Hunt Yourself. 

The employer accepts in such a case and agrees upon, that in no way the employer is entitled to claim back the first part of the bonus as it has already been paid for or should have been paid for by Go Head Hunt Yourself to the jobseeker / candidate. 

6. If a payment has to be made as described in Article 4.5, the jobseeker will have to provide us with its bank account number, transaction code (IBAN) and related address. This can be provided by filling in the form “Claim Bonus”. Jobseeker accepts and agrees upon that it is his sole responsibility to provide us with this information and those payments can only take place if the jobseeker will do so.

Jobseeker accepts and agrees upon that the appropriate portions of the bonus can only be paid by GoHeadHuntYourself to the candidate if the employer has paid the bonus to Go Head Hunt Yourself. Go Head Hunt Yourself will pay the first part of the bonus within 30 days after having received the bonus amount of the employer.

The second part of the bonus will be paid to the candidate within 30 days after the employer has informed Go Head Hunt Yourself that the candidate has passed positively the trial period, see Article 4.5. The jobseeker agrees upon not to make any claims on interest payment.

7. If a payment (refund) to the employer, under the provisions of Article 4.5 have to take place, the employer must provide Go Head Hunt Yourself with its bank account number, transaction codes (IBAN)  and related address. This can be provided by filling in the form “claim refund bonus”. The employer accepts and agrees upon that it is his sole responsibility to provide us with this information and that payments can only take place if the employer will do so. The employer agrees upon not to make any claims on interest payments.
8. The provisions of Article 4.1 to 4.7, for 1 candidate are applicable for each vacancy. If the employer is looking for multiple candidates for the same function, then the provisions of paragraph 4.1 to 4.7 are under the same conditions applicable for every candidate to be hired.
9. The subscription fee for jobseekers (working or not, interim specialist, students and trainees) is valid for a period of 12 months. If the status changes from unemployed to employed, the jobseeker has to upgrade his subscription and fee with a new period of 12 months as an employed jobseeker starting on the date the situation has changed. If the situation changes from employed to unemployed, the jobseeker can subscribe as an employed jobseeker and pay only the related new fee whenever a new subscription period starts. User agrees specifically that Go Head Hunt Yourself will not refund any months or period left of the fee as being subscribed as an employed while the actual situation has changed to unemployed. This applies to any form of subscription which has to be changed from a higher to a lower fee.  However User has to registrar his / her new working status on the personal page as soon as the new working status is present. User is obliged to registrar users correct and actual working status at its personal page, so employers will be provided with the correct and actual information of the jobseeker so that the jobseeker can claim his/her  bonus if hired.
10. In regard to the subscription fee; the euro has been chosen as the standard currency in this website. Prices in US dollar and English pound may vary according to chances on the market in regard to the Euro. Therefore; the fees can be a little bit less or a little bit more than the fees mentioned on the subscription page. The actual rate will be calculated by PayPal when you pay your subscription fee.

ARTICLE 5 VACANCY COMPLETED
1 If the employer has hired the candidate (s), the employer is obliged, as soon as possible but no later than 4 working days after hiring, to inform Go Head Hunt Yourself by filling in and e mail the appropriated form to This e-mail address is being protected from spambots. You need JavaScript enabled to view it .
2 From the moment a jobseeker is assumed (contracted) by the employer, the employer requires the rewarded bonus and the related compensation to Go Head Hunt Yourself to pay, in line with and under the condition stated in Article 4.1, 4.2 and 4.5.
3 If the employer does not appoint the jobseeker in the function for which jobseeker is originally invited, but appoint jobseeker in another function, then the employer is also obliged to pay the fee and bonus in accordance with the provisions of this Agreement
4 Go Head Hunt Yourself is entitled, if and to the extent necessary or desirable to establish the performance of any job, to verify with the employer or the jobseeker whether or not a candidate is hired by the employer. Employer and jobseeker agrees upon this verification by Go Head Hunt Yourself if needed and will cooperate in any form to provide the information needed to verify. 
5 To fulfill the financial obligations by G o Head Hunt Yourself, the employer is obliged to provide GoHeadHuntYourself its bankaccount number and IBAN code.
The invoice will include the current bonus, plus the Fee, plus Vat on the total amount as described in Article 4.1 and Article 4.2. Employer is obliged to pay the invoice within 14 days after the invoice date.

ARTICLE 6 VACANCY EXCLUDE OR WITHDRAWAL
1 The employer will end the open vacancy when the candidate(s) is (are) found, so no longer candidates can react to assumed open vacancies. The employer will in such a case mark the status of the vacancy to "fulfilled”. 
2 The employer's can end at any time ongoing vacancies, provided that no application procedures are ongoing. The employer will in such a case mark the status of the vacancy to "withdrawn". 

ARTICLE 7 CONDITIONS FOR USE BY EMPLOYERS RESUME
1 The employer is obliged to be discreet with the resumes. The employer will respect the applicable privacy laws and regulations. 
2 The employer states to use the resumes only for internal use. This means that it is not allowed to send resumes or information about candidates to third parties if the Jobseeker has not explicitly been requested to do so and granted his / her consent.
3 Go Head Hunt Yourself can under no circumstances be held liable for the contents of resumes or subsequent damage or loss. All resumes received by the employer, will be carefully stored.

ARTICLE 8 WARRANTY
1 The Service is provided on the basis of principles "as is" and "as available". Go Head Hunt Yourself makes no warranty, implicit or explicit, regarding the Service, including, but not limited to:
-implied warranties or conditions regarding completeness, accuracy and adequate quality
-a minimum number of more or less appropriate candidates for each job search at any moment, and fitness for a particular purpose.
-a minimum number of more or less appropriate vacancies per search, at any time or fitness for a particular purpose.
 
The User acknowledges:
1. That it is technically impossible to Go Head Hunt Yourself to provide the Service without failure and that GoHeadHuntYourself is not required to do so.
2. That interferences can or may cause the service temporarily to be unavailable.
3. That the results obtained by the use of the Service may contain inaccuracies or typographical errors.
4. That the operation of the Service may be adversely affected by other circumstances and factors which Go Head Hunt Yourself' can not control, including but not limited to, communication links between GoHeadHuntYourself and the employer, or between different parts within the organization of Go Head Hunt Yourself, and between Go Head Hunt Yourself and other systems and networks.
5. That certain information, such as software and its content, is obtained by third parties and therefore Go Head Hunt Yourself can give no guarantees of any nature
offered by such information.

ARTICLE 9 THE LIMITATION OF LIABILITY
The Service of Go Head Hunt Yourself acts as a venue for employers/recruiters to post jobs and search for candidates, and for candidates to post resumes and search for jobs.

Go Head Hunt Yourself is not involved in any way, included but not limited to; the transaction, communication, hiring or refusing candidates by employers or anything else what may occur between employers/recruiters and candidates as a result of making use of the Service and therefore has no control on this process. You acknowledge and agree that the user is solely responsible for all his actions, the accuracy, form and substance of any of users content that is posted on the website.

Except as expressly provided in these Terms, in no event shall Go Head Hunt Yourself, or its employees or any third parties appearing on the website be liable for any damages whatsoever, including without limitation any direct or indirect, special, incidental, or consequential damages, damages for lost profits, lost business, loss of revenue or loss of use, and any other losses or expenses arising out of or related to this website, any information received from this Website, any e-mail distributed to any user or member from the Website or any linked website or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, whether such damages arise in contract, negligence, tort, under statute, in equity, at law or otherwise. Even if Go Head Hunt Yourself is advised of the possibility of such damages, losses or expenses. In no event shall GoHeadhuntYourself , it’s employees or any third parties appearing on the Website be liable for or in connection with any information or content posted, transmitted, exchanged or received by or on behalf of any user or other person or entity on or through the Website.


ARTICLE 10   BEHAVIOUR / CONDUCT OF USER
1)
The User obliges not too make use of the Service:
1.1 for any unlawful purpose
1.2 To perform acts that could lead to the Service to be interrupted damaged, less efficient or the functionality of the Service, in any manner, could affect
1.3 To disseminate, transmit or upload material that is defamatory, abusive, obscene or threatening nature, or for any other reason that may cause irritation, inconvenience or unnecessary unrest
1.4 For spreading, sending or uploading computer viruses or other harmful files or programs
1.5 In a way that constitutes a violation of or infringement upon the rights of any natural or legal person (including, but not limited to, copyright or right of confidentiality)
1.6 For creating a false identity with the intent to mislead others on the identity of the sender or the origin of a message
1.7 To send, post, email, upload or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail", "spam", chain letters, pyramid schemes or any other form of duplicative or unsolicited messages.

2).  Go Head Hunt Yourself exercises no control over the content on the Service User  stream and can therefore give no guarantees regarding the accuracy, integrity or quality of such content.


3). By using the Service, User acknowledges that the User may be confronted with content of insulting or improper nature. GoHeadHuntYourself accepts no liability for any content or any damage arising from the use of the content which is sent to the Service, is e-mailed, or otherwise transmit and distributed via the Service.

4) The User acknowledges that the content put on the website of  GoHeadHuntYourself by user, is not checked beforehand by GoheadHuntYoerself. GoHeadHuntYourself has the right (but not the obligation) to verify content that is available via the Service, to monitor, to refuse or to delete it.

ARTICLE 11 INTELLECTUEL PROPERTY
User acknowledges and agrees that all proprietary right, title and interest (including, but not limited to, copyright and trade secret) that are part of the Service or become part of the Service, will remain property of GoHeadhuntYourself or its licensors

ARTICLE 12 LIMITATION ON LIABILTY

1) Neither Go Head Hunt Yourself its parent, affiliates, or subsidiaries, or any of their respective directors, employees, agents, vendors or suppliers will be liable for any direct, indirect, special, punitive, consequential or incidental damages including, without limitation, lost profits or revenues, costs of replacement goods, loss or damage to data arising out of the use or inability to use the Website or any GoHeadHuntYourself advertisement, or damages from the use of or reliance on the information present on this Website, even if Go Head Hunt Yourself has been advised of the possibility of such damages.

 2) The User acknowledges that Go Head Hunt Yourself does not control the nature of the content of the information which is sent or received by the Users of the Service and that Go Head Hunt Yourself is not obliged to check for what the User is using the service for. 

3) The User agrees to fully indemnify GoHeadHuntYourself in relation to any claims or legal action being taken by any other (legal) person to Go Head Hunt Yourself as a result of making use of the Service by the User.

ARTICLE 13 SUSPENSION AND TERMINATION

Go Head Hunt Yourself has the right to suspend or terminate the Agreement with the User immediately, if the User violates these terms and conditions.

ARTICLE 14 PRIVACY POLICY
The information that the User makes available to Go Head Hunt Yourself will only be used in the context of the Agreement between the User and Go Head Hunt Yourself as well as under the terms of the Privacy Statement Go Head Hunt Yourself.

15 ARTICLE LINKS ON THE WEBSITE
The Website may contain links to websites operated by parties other than Go Head Hunt Yourself. Such hyperlinks are provided for reference only. Go Head Hunt Yourself does not control such websites and is not responsible for their contents. The inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites or any association with their operators. If you decide to access any of the third party sites linked to this website, you do so entirely at your own risk.

ARTICLE 16 AMENDMENTS IN RESPECT OF TERMS AND CONDITIONS AND THE SERVICE
Go Head Hunt Yourself reserves the right to change these terms and conditions from time to time. It is User is solely responsible to verify on a regular base if the terms of use have been updated. If the user does not agree with the amended terms and conditions of this contract, then the user must immediately stop using the Service. Go Head Hunt Yourself also reserves the right to update, to optimize or otherwise adapt the Service.

INVALID PROVISIONS ARTICLE 17
If for any reason one or more of these provisions are not deemed applicable by the court in certain circumstances, the remaining provisions will subject the non-applicable provisions, as far as possible connection can be found to a similar provision, which can be considered applicable.

ARTICLE 18 WAIVER
No waiver of Go Head Hunt Yourself will be interpreted as a waiver in respect of any prior or subsequent breach of any provision.
